Is smoking considered damage to a rental property? - property rental agreement

We have a lease is not accurate because I do not smoke smoing, but her new boyfriend smokes in the city. Is it legal to look at the negative effects of smoking on the leased property for lease violations?

  1. How Reenzz, not smoking is by normal wear. The tenant does not have the choice to smoke or. The smoke into the air ducts, carpets, stains on the walls, etc. and it is not easy to go once your there.

  2. Most of these posters are far from what the law means. Although smoking is or is not written in the lease, the tenant has not relieve the damage they caused by smoking. Smoking damage is not as "normal wear and tear" and can not as damages. Although not a violation of the lease, if not specified in the lease cleaning .... are caused by smoking, can be deducted from the deposit.

  3. It is not legitimate, unless it is expressly written into the agreement. It would be used rather than normal wear and tear and if this alone is not sufficient reason for the return of the deposit is not all.

  9. If you have a specific clause in the lease agreement indicating "No Smoking" as I understand it, can not be written regarded as damage. You can contact the landlord and the tenant agency and local authorities to see if you are looking for some recourse to the smoking ban. If not, please wait until the lease must be renewed, the ban of adding the clause "Smoking" sign in front of the tenant.

    I suppose if there is any kind of burning / film on the walls, smoking, etc., but only if there is nothing in your lease that says that I do not.
    A carpet cleaner and have a good smell of cleanliness.
